This privacy policy (the "Policy") is an electronic record in the form of an electronic contract which are governed and construed in accordance with applicable laws in the Republic of Indonesia (Applicable Laws), especially Law No. 11 of 2008 as amended by Law No. 19 of 2016 on Electronic Information and Transactions (ITE Law). This privacy policy does not require any physical, electronic or digital signature.

This Policy is between PT Rimba Indo Guide, a company incorporated under laws of Indonesia, and having its registered office at Jalan Raya Anyar Gang III No. 2 Br. Anyar, Desa/Kelurahan Kerobokan Kelod, Kec. Kuta Utara, Badung, Bali, Indonesia (hereinafter referred to as "RIG" or "We" or "Us" or "Our", and the guest users or visitors, the registered users of the Website, and third-party service providers, who is either a natural or juridical person (hereinafter referred to as "Data Subject" or "You" or "Your" or "Yourself").

This Policy sets out how PT Rimba Indo Guide collects, uses, processes, protects & shares any information that You give to Us. We are committed to ensure that Your privacy is protected at all possible, reasonable and commercial extent, as Your privacy on the internet is of the utmost importance to Us. YOU FURTHER REPRESENT AND WARRANT THAT SUCH COLLECTION, USE, STORAGE AND TRANSFER OF YOUR INFORMATION SHALL NOT CAUSE ANY LOSS OR WRONGFUL GAIN TO YOU OR ANY OTHER PERSON.

This Policy is a legally binding contract between You and RIG, whose Website, You use or access or You otherwise deal with. This Policy shall be read together with the other terms and conditions of the Website (if any).

1.1. Personal Information obtained from You or from Your mobile device directlyWe may use Personal Information collected for any of the following purposes as well as for such other purposes as are permitted by Applicable Laws:

(c) To compare and verify the Personal Information with third parties to ensure that the Personal Information is true, accurate, and correct;

(e) To enhance Our promotional or marketing purposes;

5.2. Third-party ad servers or ad networks may serve advertisements on the Website. These third-party ad servers or ad networks may automatically receive Your internet protocol address, when they serve ads to Your Internet browser. They may also use other technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of their advertisements and to personalize the advertising content. However, please note that if an advertiser asks RIG to show an advertisement to a certain audience and You respond to that advertisement, the advertiser or ad-server may conclude that You fit the description of the audience they are trying to reach. RIG's Policy does not apply to, and We cannot control the activities of, third-party advertisers.

6. INFORMATION SECURITY & RETENTION

6.1. We take precautions – including administrative, technical and physical measures – to safeguard Your personal information against loss, misuse or theft, as well as against destruction, alteration, disclosure and unauthorized access. For this purpose, RIG adopts internal reviews of the data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems, where RIG stores Your Personal Information, provided that Your right to claim damages shall be limited to the right to claim only statutory damages under ITE Law and You hereby waive and release RIG from any claim of damages under contract or under tort.

6.2. When You use Our services or Website, some of the Personal Information You share is visible to other users and can be read, collected, or used by them. You are responsible for such Personal Information You choose to submit in these instances. For example, if You list Your name and email address on the Website, that information is public.

6.3. Your Personal Information will be retained as long as it is required for the purpose it was collected. The period for which it is stored may extend past Our business relationship but will only extend insofar as to provide Us with sufficient information to respond to any issues that may arise and to comply with Applicable Laws and regulatory requirements. We shall cease to retain Personal Information, or remove the means by which the Personal Information can be associated with You as an individual, as soon as it is reasonable to assume that the purpose for which that Personal Information was collected is no longer being served by retention of Personal Information and retention is no longer necessary for legal or business purposes.

6.4. RIG may share Your Information with third parties. In the event We share Your Personal Information to third parties, You agree and acknowledge that the retention of Your Personal Information by the relevant institutions will follow their respective policy on data retention. RIG is not responsible for any breach of security or for any actions of any third parties that receive Your Personal Information. Notwithstanding anything contained in this Policy or elsewhere, RIG shall not be held responsible for any loss, damage or misuse of Your Personal Information, if such loss, damage or misuse is attributable to the Your error and/or negligence or a Force Majeure Event (as defined below).A "Force Majeure Event" shall mean any event that is beyond the reasonable control of RIG and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer, computer system or computer network, computer crashes, breach of security and encryption (provided beyond reasonable commercial control of RIG), power or electricity failure or unavailability of adequate power or electricity.

6.6. While We will endeavour to take all reasonable and appropriate steps to keep secure any Personal Information which We hold about You and prevent unauthorized access, You acknowledge that the internet or computer networks are not fully secure and that We cannot provide any absolute assurance regarding the security of Your Personal Information. Please exercise reasonable caution when determining what Personal Information You disclose via the Website.

6.7. We will provide a written notification along with the reasons or causes for the failure of the protection of Your Personal Data at the first opportunity when there is a failure in the protection of Your Personal Data in Our system, within a period of no later than 3 days after the failure is known by e-mail and a letter to the address You have provided to us.

7. RIGHTS OF THE DATA SUBJECT

7.1. Pursuant to ITE Law, We respect and uphold Your rights in relation to the collected personal information such as the right to withdraw consent, update, correct, delete, access Your Personal Information. We reserve the right to charge an administrative fee (if applicable) for the execution of Your right under this Clause.

7.2. We reserve the right to refuse Your requests for access to, or to correct, some or all of Your Personal Information in Our possession or control, if permitted or required under any Applicable Laws. This may include circumstances where the Personal Information may contain references to other individuals or where the request for access or request to correct is for reasons which We reasonably consider to be trivial, frivolous or vexatious.

8. HOW YOU CAN ACCESS OR UPDATE YOUR PERSONAL DATA

You can access and update the information You have provided to Us by emailing Us. To protect Your privacy and security, We will take reasonable steps to verify Your identity before granting access or making corrections to Your information. It is important that the personal data You provide to Us is accurate and complete for Us to provide the Services.
